Almost every diamond business in Antwerp has security cameras, but using them comes with a set of legal obligations. That is why we like to take this opportunity to remind the Antwerp diamond companies of their obligations in this matter.
1. Clear signalization: Every room with a camera must display a camera icon that is clearly visible, no exceptions. Hidden cameras are not allowed, and cameras in sensitive areas like changing rooms or bathrooms are strictly forbidden. Also: the employer should inform their employees about all cameras through the Committee for Prevention and Protection at Work (CPPW) and the internal work regulations document.
2. Registration of security cameras: Every security camera must be registered at www.aangiftecamera.be. This registration needs to be renewed every year. Setting a recurring calendar reminder is a practical way to avoid missing this deadline.
3. Control and log who can watch the footage: Not everyone should have access to camera footage. It is vital to make sure access is technically secured, and to keep a written log of:
- Who is responsible for privacy and compliance
- Who has access to the footage
- Who has handled any requests related to the footage
- Who is the single point of contact for camera-related inquiries
4. GDPR requirements: Employees, customers, and suppliers all have the right to request to view footage in which they appear, and to request its deletion.
5. Maintaining a processing log and timely deletion of footage: A company that uses security cameras must maintain a processing log documenting how camera data is handled. Footage may be kept for a maximum of 30 days. The only exception is when an incident has occurred. In that case, relevant footage may be retained longer.
